BSES YAMUNA POWER ISSUES NOTICES ...THEFT OF ELECTRICITY

I am informed that a large number of consumers in areas like Krishan Nagar, Shahdara and adjoining colones have received notices, directing them to visit BSES office and are made to sign some papers. Kindly recall my earliest posts. I had and still offered my services to any RWA.SOCIETY OR INDIVIDUAL in connection with safety(to avoid electrical accidents) and harrasement cases.

KINDLY NOTE THAT in the event of actual theft...i will not be of any use. The following information may be of use ...so kindly read :

It is no body’s case that theft of electricity by consumers is to be defended. I would say such activity is to be CONDEMNED and punished. But let us understand theft of electricity and how bogus cases are built up.

THEFT OF ELECTRICITY
The distribution agency, be it electricity board or private company, arranges to measure how much energy is consumed by the consumer. Arrangement is also made to measure maximum load ( in terms of Kilowatt etc) in say one month or period specified in CONDITION OF SUPPLY. This is being done by recoding readings manual or through electronic capturing device.
Such readings are then transferred or recorded in books known as METER READING BOOKS.
Extraction of electricity bypassing such devices is known as theft of energy. In the event of sudden drop of recorded consumption....the meter reader reports if the meter has stopped recording or is burned or damaged. Thereafter, such installations are kept under observations. In the event of PRIMAFACIA EVIDENCE, the raids are conducted and in the event of theft, photographs are taken, report prepared by inspection team and got to be signed by CONSUMER OR HIS(HER) representative.

However, there are very many incidents of framed up cases to extract money. In some cases there could be genuine mistakes committed by inspection team. There could be suspected cases of theft. The consumers receiving such notices MUST ACT WITHOUT DELAY. In the event of proven theft, there could be IMPRISONMENT besides financial burden.

My suggestion is that consumer receiving such a notice must take advice of knowledgeable PERSON. However in the event of theft or efforts to tamper with meter... the culprit must be ready to face consequences.

Accupressure Camp

An Accupressure check up camp is to be held at Gurdwara Singh Sabha, F Block, Krishna Nagar, Delhi - 110051. Mr. Grewal, Gen. Secy. of the Gurdwara committee has informed that on 23rd & 24th March, patients can get free check up at this camp. If successful, the camp will be repeated soon.

Those who know must be fined thousand time than an ordinary person

Manu said that higher the station in life..the stiffer the fine and punishment for a crime committed by king or top person who gets the rules and regulations implemented. It is observed that MCD due to obvious reasons is shirking in its responsibility to collect legitimates dues, be it on account of approval of mobile phone towers or property tax. But our authorities are not shy of putting their hands in the pockets of poorest of persons to enhance property and other taxes. While disposing of second appeal , CIC(CENTRAL INFORMATION COMMISSION ) directed that guide line to approve location of mobile phone towers be put up on web site of MCD for information of all concerned.

MCD admitted that out of around 4500 towers throughout DELHI, around 2500 have been been in service without any clearance. Mobile service were introduced in 1995 and rupees one lac fee per tower was to be deposited by service providers. Imagine colossal loss caused by corrupt officers and staff who looked other wise, flouted existing rules and regulations and the greed of multi national companies who made quick buck by way of sale of air time. This happened in NOIDA and this happened in DELHI.

I was appearing along with the complainant Sh.Karam Chand when appeal his second appeal was heard and allowed. MCD was directed to identify staff who was responsible for allowing these mobile towers and thus causing immense financial loss to MCD. The order of CIC is available on their web site.

Similarly, MCD is lax to see that at least educational institutes follow MCD RULES regarding adherence to the very purpose for which plot of land is allotted. In case land is allotted for primary school around 1990—1991 and there after school building comes up for ten plus school and professional courses are run besides construction of residential complexes, then there is need to wake up. I am referring to the case of Universal Public School Preet Vihar.

Incidently CCN NEWS HAD INTERVIEWED THE THEN AREA COUNCILLOR SH.RAMESH PANDIT, SCHOOL PRINCIPAL and my self and covered it as a news item on 22/09/2006 on TV CHANNEL. PGC already closed this case by directing SDM PREETVIHAR (DY.COMMISSIONER EAST DELHI ADMINISTRATION) to take cogninance under relevant criminal code and get the public road vacanted from Universal Public School, PREET VIHAR NEW DELHI 110092.

PGC is reviewing status on 12 th april 2010 and have directed dy.commissioner shahdara south zone to file status report through their engineers who have been directed to be present on said date at 3PM.

DELHI is the capital of India. I do not know what type of example we are setting for others to follow.

Empowerment of RWA's

I had attended this meeting in Town Hall Ch.Chowk, as Secretary RWA Pocket-3,Mayur Vihar-1, Mr. O.P. Sehgal President Federation Mayur Vihar-1 was also present in this meeting. The Presentation was elaborated by the Ch. Engineer MCD. During open discussion it was pointed out that the norms for the security Gates were too general and shall not fit for every place and every entry-Exit point. The only common point which needs the attension are that :

1) The Gates must be maned round the clock.

2) The Hight and width of the Gates must not block the entry of Fire tenders, Ambulance, etc. at the time of emergency during day and night.

3) If entry gate Exit gates are avilable the above system be stritly followd. Only one gate should be used at Night from 10.00PM to 6.0 AM for security of the residents.

4) If only one entry & Exit gate is available for opening and closing the gates must have security guards ( minimum 2) round the clock.

5) If the RAW is following the above norms properly than WHY & HOW RWA should be accountable for any mishaps ? Where is mishap in installing such security gates ? What about House braking / thefts /chain snatching / Acid throwing etc. every where even after the security gates are there or not ?

It is observed that many times, mostly at nights, some drunk car drivers or Trucks with building materials or Delivery vans/ trucks of Tent suppliers force their entry, late at night, from the gate which is closed ! where as the other gate is open BUT these persons are seen fighting and abusing and beating the duty Gaurds to get the Closed gates open as per their desires ? During marriges, even in nearby place, it has become a show off to park cars in side the gates at will and open drinking starts on car tops ? The Gaurds dare to stop this at the gates ! RWA has NO powers to check/stop this and the Police/MCD is not to be seen there. Should RWA be held accountable for these activities ? by just installing gates only.

Where are the powers with the RWA to set right such unlawful activities by the residents or outsiders ? The only action taken by the RWA is to call Police help, which, we all know how fast is this task to get police help ? at the time of actual need.

Therefore, it is my humble suggestion to the authorities to form watch & Ward committees of Sr.Citizens from the recommendations of the Residents of that Area and RWA to have the powers to directly co-ordinate with Area Police, MCD, DJB, Power supply etc.officials MLA or Muncipal Councelor to help the Residents as well as Govt. agencies at the time of need to have peace, security and proper community services to all.

property tax and collection

Why mcd has to announce amensty every two years . property tax department is either lax or under some invisible orders not to tax subdivision of shops even in commercial mkts like PREET VIHAR and MADHUVAN.

Despite residents pointing out....mcd is lacking in efforts. We want to know suppose a school got land for primary school but running upto 12th and other courses..is it permissible under law and if not then how such institutes are functioning for more than twelve years.

SC: No registration of property below govt circle rates

The Supreme Court has ruled that property cannot be registered below the circle rates fixed by the government.

A bench comprising Justices Dalveer Bhandari and Mukundakam Sharma, while allowing the appeal of state of Haryana, noted ‘It may be pertinent to mention that in order to ensure that there is no evasion of stamp duty, circle rates are fixed from time to time and the notification is issued to that effect.

‘The issuance of the said notification has become imperative to arrest the tendency of evading the payment of actual stamp duty.

‘It is a matter of common knowledge that usually the circle rate or the collector rate is lower than the prevalent actual market rate but to ensure registration of sale deeds, at least at the circle rates or the collector rates, such notifications are issued from time to time by the appellants.’ Justice Bhandari, speaking for the bench through his 17-page judgement further said, ‘It would have far reaching ramifications and consequences if the genuineness of the sale price entered into by the buyer and the seller cannot be questioned, then in majority of cases it is unlikely that the state would ever receive the stamp duty according to the circle rates or the collector rates. The approach of the High Court is totally unrealistic.’ In the present case, Manoj Kumar had purchased a commercial plot measuring 788 square yards in Faridabad on November 10, 1999 and paid only Rs 31,000 as stamp duty by under-valuing the price of the plot at Rs 1, 95,000.

Faridabad District Collector, however, demanded the stamp duty of Rs 5,13,050 at the circle rate of the plot (i.e., Rs 4,200 per square yard) and the value of the property worked out to be Rs 33,09,600. Authorities told Manoj Kumar to pay the balance stamp duty of Rs 4, 82,050.

Appeal of Kumar was dismissed both by the District Collector and Commissioner Gurgaon.

COLLECTION OF PROPERTY TAX - RWA's CAN ASSIST

Every year MCD announces the Amnesty Scheme and spends crores of rupees on advertisements to encourage people to pay property tax. Reportedly, many people are scared of standing in long queues, and the behaviour of the staff attending to them is also not very pleasant. As a result, they go on postponing the payment and finally miss the deadline.

A suggestion - MCD should make the form consumer friendly, and in case there are no structural changes in theproperty, payment should be accepted with a copy of last year's receipt. RWAs should be roped inwith some incentives to collect the property tax from the residents of their respective colonies on behalf of the MCD.

In my opinion people would gladly pay if they don't have to go to the MCD office and stand in long queues. Why not MCD give it a try.

Few VIP categories to be exempt from frisking in US

After the frisking fiasco involving former president APJ Abdul Kalam on a US-bound American airline last year, the US aviation security department, Transportation Security Administration (TSA), has conveyed to its Indian counterpart that it may exempt four to five categories of VVIPs from frisking before entering its aircraft.
The VVIP list is likely to include past and present presidents, the Vice-President, the Prime Minister and the present Union Cabinet. The list has been pruned down from some 30-40 categories of VVIPs, which currently figure in the country's Bureau of Civil Aviation Security (BCAS) list who are exempted from frisking.
The matter had come up for detailed discussion during a meeting of the Indo-US joint working group held in January this year.
"A formal response from the TSA is awaited. However, they have agreed in principle to exempt four-five categories of VVIPs from frisking ahead of boarding a flight," said a senior civil aviation ministry official. The list will be prepared and finalised at the next meeting of the ministry with the US security agency.
Since such privileges are extended on a reciprocal basis, India will also review the list of US dignitaries it wants to exempt from frisking.

Govt To Ask For NGO Help In Rehabilitating City's Beggars

The Delhi government is having trouble getting rid of the city's beggars before the Commonwealth Games. Attempts to get states like Bihar, Madhya Pradesh and Orissa to take back `their' beggars have been unsuccessful so far.
With space for only 2,100 beggars in its homes, no rehabilitation plan in place and the city teeming with thousands of beggars, the Delhi government is now hoping to rope in the voluntary sector to help rehabilitate beggars in the city and to facilitate their return to their native villages in other states.
The department of social welfare is planning on taking out an advertisement, asking for NGOs to help in the rehabilitation process. After a meeting with the social welfare secretary on Friday, chief secretary Rakesh Mehta said he has asked officials to prepare a plan with the focus being on the rehabilitation of beggars.
Mehta said beggars were being rounded up by mobile beggar courts from time to time. But he expressed concern about their future, saying they would have to be released after they had completed their one-year jail terms. So, the problem remains. Moreover, what happens when space in the government's homes for beggars is exhausted? Social welfare secretary Manoj Parida said there is space for 2,100 beggars in all the homes. Right now, there are about 900 beggars in these homes.
The government has written to the states from which most of Delhi's beggars come. But it has not got much of an answer. The chief secretary said states like Bihar and Madhya Pradesh have shown no interest in taking back their beggars. Uttar Pradesh and Orissa have also expressed their reluctance. Haryana and Rajasthan have not refused but they have responded vaguely, said senior officials.

Verify Your Servant, Or Pay Rs 5,000 Fine

You may soon have to pay a fine of Rs 5,000 if the police find you haven't got the antecedents of your domestic help verified by them.
This is one of a number of changes in the job responsibil- ities of the police force the gov- ernment intends to bring about.
It will be incorporated as an amendment to the Delhi Police Act, likely to passed before the year-end. The proposed amend- ments were released on Friday. Another amendment sug- gests that the making of hoax calls and stalking should both be punishable offences. "No per- son shall wilfully make crank telephone calls or stalk any per- son with the intent to create a sense of harassment, nuisance, injury or fear," the draft says, spelling out the punishment for these crimes.
Till now there was no specif- ic law under which these offend- ers could be booked, and thus they often got off lightly.
