Do they have the right to collect the Conversion as well as the one time parking charges?

As per the Bare Act of DDA, ”Escrow Account" means a dedicated savings account held by the Local Body concerned not being operative unless the conditions for which it has been opened are fulfilled in accordance with the provisions of these regulations”.

In such a case how Civic bodies either diverted the Amount collected under this Account for other establishment expenditure including salaries or failed to use most of the amount, is a very serious cause of concern for one & the all.

However, the data submitted shows that the Municipal Corporation of Delhi collected Rs. 1,128.72 crore from 2006-2007 till 2011-2012, but only about 8% or Rs. 101.39 crore was spent through the escrow account on developing the areas or creating parking. The majority of the fund or Rs. 1,027.33 crore was spent on “other establishment expenditure”, which includes salaries.
MCD split
After the MCD was split into three in 2012, the North Delhi Municipal Corporation collected Rs. 643.41 crore from 2012-2013 to 2016-2017. Only Rs. 28.19 crore was spent on escrow expenditure, while the remaining Rs. 615.22 crore was spent on other establishment expenses.
While the North Corporation diverted the majority of the funds, the South Delhi Municipal Corporation (SDMC) failed to use most of the parking and conversion charges it collected. From 2012-2013 till 2016-2017, the SDMC collected a total of Rs. 1,125.05 crore, but the expenditure from the escrow was Rs. 146.87 crore. Currently, Rs. 925 crore is available in the account, SDMC data shows.
The East Delhi Municipal Corporation (EDMC) collected Rs. 166.02 crore in conversion charges and Rs. 49.95 crore in parking charges from 2012-2013 till 2017-2018 (till now). The EDMC data showed that the civic body spent Rs. 8.38 crore of the parking charges on developing parking, while Rs. 18.16 crore was spent on salaries and Rs. 23.40 crore remained unused. We are trying to find out the status of the rest of the Rs 166.03 crore.

In such circumstances, do you think that our Civic bodies have any right to collect the Conversion as well as the one-time parking charges?

It was said earlier that no development charges for parking shall be payable by small shop owners of the area up to 20 sqm. dealing with the items/activities as defined in para 15.6.3 of the MPD-2021 in respect of any category of colonies.

But now, development charges for parking are being demanded even from the small shop owners. Is there any such change in the Act?

It was also said earlier that Development charges for parking shall also not be payable by owner/ allottee/resident/user of the plot/dwelling units falling under notified pedestrian shopping streets both mixed-use or commercial pedestrian streets.

Traders Get A Month's Time To Pay MCD


Traders in the city now have a month's time to pay conversion charges to ensure their establishments are not sealed. The Municipal Corporation of Delhi (MCD) has also decided to come up with the rates that the local shop- ping centres need to pay.

HT, on May 28, had report- ed about the fact that although the MCD had decided to start the sealing drive, it had not informed the traders how much they were supposed to pay.

"Traders can pay conversion charges till June 30. We have decided that no units will be sealed until then," said MCD's Additional Commissioner R.K.Srivastava. Several councillors had raised the issue of sealing at a meeting of the standing com- mittee. The new chairman of the MCD standing committee, Yogender Chandolia, had said traders who wanted to pay the conversion fee should be given time to do so. "The system of collecting the charges at the MCD zones should be stream- lined. We do not want to put additional burden of sealing on the citizens," he said.

Sealing, demolition back from June 1


From June 1, traders in Delhi will face a tough time with the return of sealing and demolition. The Supreme Court appointed monitoring committee on sealing of unauthorised commercial establishments has directed the Municipal Corporation of Delhi (MCD) to start sealing local shopping centres for non-payment of conversion charges.
Most such shopping centres are located in areas such as South Extension Part I and II, Defence Colony, Greater Kailash I and II, Lajpat Nagar, Rohini, Saket. The committee has also asked the MCD to demolish all illegal construction carried out by the owners at these shopping centres. According to the civic body, many shopkeepers have constructed additional floors illegally. These will be demolished.

The sealing and demolition drive is expected to begin from South and Central zone of the MCD. In each area, more than 100 such shops will be affected. In South Delhi alone, nearly 700 shops will be targeted..................................................

Areas to be affected: Local shopping centres across the city will be affected including South Extension-I and II, Defence Colony, Lajpat Nagar, GK-I and II, Green Park, Rohini, Shahdara south and north among others.

Conversion Charges : NO sealing without 48 - hour notice : MCD

New Delhi, Mar 17 MCD today said no residential premises operating commercial units will be sealed without a 48-hour notice.

This assurance came as the issue of sealing of premises which have not paid conversion charges was raised in the Standing Committee meeting today.

Senior MCD officials informed the meeting that no sealing is taking place without a 48-hour notice.

According to statistics, MCD has collected Rs 729 crore as conversion charges.

The officials told the meeting that a number of cheques submitted by people as conversion charges have bounced. - (Agencies)

Why not an Amnesty scheme for the Conversion charges before the sealing drive ?

It is being heard that MCD is sealing those shops or properties which have not yet paid the conversion charges. We hereby request to the MCD that as done by you in the property tax, MCD must give a general Amnesty to all those who have to pay the conversion charges. A tax free & penality free period of even 15 days will help the shopkeepers to clear the dues.

CONVERSION AND PARKING CHARGES - MCD will not take cheque payments

New Delhi: The Municipal Corporation of Delhi on Wednesday said that it was not accepting conversion and parking charges payments in the form of cheques as a majority of them were being dishonoured.

Said an MCD official: ‘‘We are not accepting conversion and parking charges payments in the form of cheques as many of the cheques tend to bounce. We are also facing a similar problem with regard to cheque payments made for property tax, advertisement payments etc.’’ Meanwhile, Congress councillor captain Khavinder Singh said instead of sealing an entire building — which is the present practice — MCD should seal floor wise after ascertaining which floors have made payments and which have not. MCD’s standing committee said they would make required amendments in its present policy.
