New Lokpal bill 'worse' than old one: Team Anna

Team Anna on Thursday rejected the Lokpal bill describing it as "anti-people and dangerous" and demanded that a new bill be brought in Parliament that will make the Central Bureau of Investigation independent and decentralise the proposed anti-corruption body.
Addressing a press conference, Team Anna member Arvind Kejriwal said the new bill was "worse" than the legislation introduced in August in Lok Sabha alleging that the government does not want a comprehensive anti-graft ombudsman.
"Under the present bill, government will have all the control over Lokpal as it will have powers to appoint and remove members at its will.
"It is worse than the Lokpal Bill introduced in August. We reject the (new) bill, withdraw it and introduce it after redrafting it," Kejriwal said. Describing the new bill as "anti-people and dangerous", he said the proposed legislation is meant to crush the rights enjoyed by people.
"Only ten per cent of the political leaders are in the bill. Only five per cent of employees are in its ambit. Big companies are out of it.

LOKEPAL BILL AND THE COMMON MAN

Lot of hype and expectations are hoped to be met through this bill. In a few days it may become law and result into great rejoicings. BUT
Existing laws are atleast sufficient to tackle small small problems which as residents of Madhuvan new delhi 110092 we brought to to the notice of joint commissioner police when he along with team of officers along with sho of area had interaction with us. Some of the salient points made are listed below for your kind information as most of our areas suffer from similar problems.

1. I offered rs 1,000/ to any body who could walk along madhuvan side foot path from shakapur T point to narula market preet vihar. This stretch is occupied by unauthorised dhabas, taxi stands(WHO SEND PVT VEHICLES AS TAXIS). EVEN area near sho police station preet vihar is surrounded by illegal buses and tempos parked in area meant for cars and two wheelers.

2. Our madhuvan colony was established by IAS OFFICERS, HIGH COUR AND SUPREME COURT JUSTICES, BESIDES LT.GOVERNOR WHO WAS RETIRED POLICE OFFICERS. I AM ASHAMED THAT OUR SOCIETY OCCUPIED 10 FT STRIP OF DDA NH PARK which was confirmed by MCD BUT STATED ACTION TO BE TAKEN BY DDA. THIS ILLEGALITY OCCURED IN 1995.

When i came to know this i apprised MC PLUS PRESIDENT OF SOCIETY but they did vacate the strip. Un believable as it may seeem MCD DID NOT SANCTION BUILDING PLANS OF OUR CC AND HENCE IT CAN BE TERMED AS ILLEGAL CONSTRUCTION.

I am only making a point that there is no dearth of laws which cannot solve our day to day problems but there has to be will to act. There was a news that councillors of BJP AND MCD HAVE BEEN DEMANDING BRIBE TO CONDONE ILLEGALCONSTRUCTIONS.

LALITA PARK ILLEGALLY BUILT BUILDING FLOUTED ALL NORMS AND RESULTED INTO DEATH OF 70 PERSONS. WHERE WERE INSPECTING AUTHORITIES.

We as rwas and societies must voice our concern and make efforts that corrupt persons get their just dessert.

Lokpal bill draft gets Cabinet nod; Team Anna, oppposition reject it

NEW DELHI: The Cabinet finally cleared theLokpal and Lokayukta bill on Tuesday evening, but their key formulations were promptly slammed by both Team Anna and the opposition, setting the stage for a continuing confrontation within and outside Parliament. 


Although government put Group C&D categories of government employees under Lokpal's purview, civil society activists screamed foul over lack of investigation powers for the anti-corruption mechanism. Retention of government's administrative control over theCentral Bureau of Investigation -- power to decide transfers and postings within the organization -- is another major bone of contention with the activists and main opposition BJP. 


Both are also cut up with the government over the composition of selection panel for Lokpal, saying that it was dominated by government's nominees. 


The proposal to split CBI's investigative and prosecution wings and place the latter under the Lokpal has not found favour, thus helping both CBI and CVC survive attempts to render them Lokpal adjuncts. According to the draft bills, CBI will report to the Lokpal only with regard to cases referred to it by the anti-corruption ombudsman. Lokpal will have a greater jurisdiction over CVC, but the latter will not be hamstrung from taking up cases on its own and referring those to the CBI. 


The government, however, agreed to end its monopoly on appointing the CBI chief and has agreed to a selection committee comprising the prime minister, leader of opposition and chief justice of India or one of his nominees. 


Also, Lokpal can initiate a preliminary inquiry in a case of alleged graft. 


The Cabinet shed its previous reservations over placing the PM within the Lokpal's ambit although the bill excludes inquiries in matters relating to areas like national security and foreign policy, space and atomic energy. Three-fourths of the Lokpal members will have to okay an inquiry against the PM, while the proceedings will be held in-camera. Here again, Team Anna differs with the draft, calling for the law to cover the PM unconditionally. 


Given Team Anna and the opposition's rejection of important aspects of the draft, there is a concern in government that the Centre will have to face both the Hazare agitation, the hostility of opposition groups and the resentment of all levels of government employees who are now covered by the bill. 


The bill states the Lokpal will be a 9-member body, including the chairperson and it will have a 50% reservation for OBCs, SCs, STs and minorities. There will be a quota in the search committee as well that will make recommendations to a 5-person selection panel comprising PM, leader of opposition in Lok Sabha, Speaker of Lok Sabha, Chief Justice of India or a nominee and a legal expert nominated by President.

CERC Hearing on 22nd Dec. ...... Pls. BE THERE

Can we leave it to the Regulators to protect our interest .......
 
Dear Friends,
 
You would remember that we had filed an application for Impleadment in the NDPL hearing at CERC some time back.
 
The hearing is on 22nd. Dec. 10.15 AM (Sharp) at the CERC office on 4th Floor, Chandralok Building, Janpath, New Delhi.
 
We should try and take out time and be there. You may have noticed that our constant vigil has started to show some results by way of steps being taken by DERC to pull up the DISCOMS. We now need to raise the bar and look into the functioning of the CERC ........ leaving the Regulators be, has not worked as they were happy making polite noises and never questioning the blatant mal practice the DISCOMS were indulging in.
 
What can be a bigger fraud on the consumer in allowing DISCOMS to purchase power from what ever source at whatever price and bill it to the consumer. We thought Financial Prudence in purchasing cheapest power available must have been a part of the Distribution Contract.
 
DISCOMS were merrily splurging in buying power on the Golf Course Circuit while Cheaper Power was available at the Power Exchange. DERC, instead of penalising them dangle a carrot of giving incentives for buying Cheaper Power. Can we really leave it to the Regulators to protect our interest?

Shastri Park Exten Part-1, Block-Uttarakhand, Burari, Delhi-84

We constituted the Society and carved out the colony named as “Shastri Park Exten Part-1, Block-UttarakhandBurari, Delhi-84” hoping to live and lead our life with hassle free, but unfortunately, we are now suffering in the colony, with severe and acute problems. Now, we are totally depressed and disillusioned but continue to survive with the optimism and confidence that the bureaucrat and politician at the helm of affairs will resolve the problems with necessary directions to the officials concerned.The main thrust areas where there is need to act on war footing:

5 years have been passed, streets particularly in Block A of Uttarakhand Colony, Part-1,demolished on the pretext that very next week all streets would be built with RCC. But till date (after 5 years), still a single brick not laid. Till date no work is performed. People are facing acute problems in coming out and entering in their house. Several time complaints made to the concerned Councilor, MLA and MP level, but futile.

Now, despite of sanctioning of tender of Rs. 4.16 crores for streets,etc, from Flood Deptt. & Rs. 1.95 crores from Jal Board, People of Uttarakhand Colony Part-1, are waiting to start the work.  But, it seems that it will not happen and again we will be left in the lurch of fate.

Police -  Ensure safety and security of the residents by various means and Patrolling the colony at least twice in the night.

"An open letter to our H.E. Lt. Governor and Hon’ble Chief Minister, Delhi !

We constituted the Society and carved out the colony named as “Anand Vihar” hoping to live and lead our life with ‘anand hi anand’, but alas we are now languishing in the colony, with problems galore! Consequently, we are totally depressed and disillusioned but continue to survive with the optimism and confidence that the bureaucrat and politician at the helm of affairs will resolve the problems with necessary directions to the officials concerned.
 
We are writing this ‘open letter’, of course, after exhausting all the official channels, right from the bottom to the top or vice versa! We are inking it with a last straw of hope, with built-in dismay. Notwithstanding, we hope to achieve the best!
 
To save your precious time and energy, we hereby express our woes and difficulties being faced by us in ‘one liners’ with genuine expectations and sanguine hope that these will receive your or your officials’ working with and for you, attention who will take up the matters with govt. agencies/officials concerned at the helm of affairs! For convenience and to facilitate your exercise, we give them below, department-wise, too! We have been struggling with the below-mentioned problems for the last two years and would like to reiterate at the fag end of the current year, so that when the new year (2012) dawns, the residents of Anand Vihar will see significant and appreciable improvements to derive ‘anand hi anand’, while living in Anand Vihar colony, the biggest Cooperative Housing Society in East Delhi. founded in 1975 in an area of 90 acres of land, initially envisaged as a total ‘plotted’ colony (with 903 independent plots), but now growing vertically and thus becoming a ‘flatted’ colony, with a population nearing 10,000!
 
1. M.C.D.        – Recarpetting of main and ‘inner roads’ of the colony which are in a very bad shape.  
Relaying and repairing of ‘service lanes’.
Removal of encroachments to facilitate mobility and parking of vehicles
- Regulate and discipline and overcome the builders’ menace which is mushrooming with   the passage of time unabatedly!
Cleaning and maintenance of storm water drains and culverts.
- Cleaning of shopping centres inside the colony.
- Periodically pruning of trees and maintenance of parks.
 
2. D.J.B.          - Abnormal increase in sewerage charges with little maintenance or service.
Replacement of worn out water pipe and sewerage lines laid about 40 years back.
Demolition of OHT and construction of UGR at the same place
                        - Mechanical cleaning of sewerage.
3. D.D.A.         - Expedite providing a linkage road (80’) from Karkarduma Junction to Sreshta
                          Vihar.
- Development of Green belt/Anand Vihar & Jagriti Enclave
- Direct the local school authorities to make available their ‘play fields’ for being used by local children of the colony, as per the prescribed provisions,
- Construction of pucca road from the DDA Community Centre (opp. Yamuna Sports Complex) to Anand Vihar railway terminal.
- Expedite construction of Community Hall and handing over the same to the Society for its maintenance by the Society.(RWA).
 
4. Police         -  Ensure safety and security of the residents by various means.
                        -  Prevent blockade of the entire road/inner lanes for various of functions by
                            local residents.
- Periodical visit to ‘senior citizens’ homes and recording their woes.
- Removal of unauthorized persons mushrooming in ‘chowkidars’ huts in the vicinity of houses under construction.
- Patrolling the colony at least twice in the night.
- Handing over the ‘nursery plot land’ presently occupied by SHO/Anand Vihar when moving out to their own building to the Society to build up and maintain a “Senior Citizens Recreation Centre”. Majority of residents are ‘senior citizens’ in the colony with no such facility.

Operator : "I'm afraid you have to pay us cash, Sir. Your credit card is over the limit and you owe your bank Rs 23,000.75 since October last year. That's not including the late payment charges on your housing loan, Sir.."

Customer: "I guess I have to run to the neighbourhood ATM and withdraw some cash before your guy arrives"

Operator : "You can't Sir. Based on the records, you've reached your daily limit on machine withdrawal today"

Customer: "Never mind just send the pizzas, I'll have the cash ready. How long is it gonna take anyway?"

Operator : "About 45 minutes Sir, but if you can't wait you can always come and collect it on your Nano Car..."

Customer: " What!"

Operator : "According to the details in system ,you own a Nano car,...registration number GZ-05-AB-1107.."

Customer: " ?"

Operator : "Is there anything else Sir?"

Customer: "Nothing... By the way... Aren't you giving me that 3 free bottles of cola as advertised?"

Operator : "We normally would Sir, but based on your records you're also diabetic....... "
