Tariff hike: Ex-minister for govt help

NEW DELHI: To take up the case of the power tariff hike further, former Union minister and convenor of Bijli Andolan Vijay Goel and Anil Sood (president CHETNA) has sought for an appointment from Union minister for power, Sushil Kumar Shinde, to lead the delegation of RWA's core committee. The andolan started from Talkotora stadium on November 27.

Reacting sharply to DERC granting extension of time to BRPL and BYPL to produce accounts/financials and details of arrangement being made by the discoms, Goel questioned the decision of DERC on the ground that the accounts of discoms have been very recently reviewed by the DERC at the time of passing tarff determination order and nothing new has happened in the last three months.

He also condemned the proposed decision of bailout by the Delhi government involving Rs. 500 crores and questioned the discom's claim of low tariffs when data available from indian energy exchange shows otherwise.

100 years of Delhi : Janpath : Delhi AajTak : B S Vohra

Exactly 100 years ago, on 12th December, 1911, Delhi became the Capital of India. The reasons for selecting Delhi as a Capital city was, that, it had river Yamuna on one side ( as a water resource ) and the Aravali extension Ridge on the other side (as its lungs). Though, developed for a population of 70,000 persons, today, after 100 years, Delhi is catering between 1.5 to 2 crores of population. The result is, that, the river Yamuna has just been converted into a big & dirty drain.

We must take necessary steps to save YAMUNA, otherwise, the reason for selecting Delhi as a capital city will vanish & the sufferers will be Delhite’s.

madhuvan residents tryst with joint commissioner police

RWA had been requesting commissioner police to kindly give us time to explain madhuvan residents problems.
i raised following points and others also made similar points.
madhuvan is a small colony with 225 plots,and most of occupants are senior citizens.needing special care.
Police need to intensify day and night patroling.
the footpatth from shakarpur to preet vihar on madhuvan side is illegally occupied by DHABAS, UNAUTHORISED TAXI STAND WHO SEND PRIVATE CARS INSTEAD OF TAXIS.
NEAR SHO office in CC PREET VIHAR MARKET, THERE is a parking lot meant for cars and two wheelers.
MOST OF THE TIME IT IS FULL OF COMMERCIAL VEHICLES LIKE BUSES AND TEMPOS.
FURTHER , TAXI STANDS , FLORISTS HAVE OCCUPIED FOOTPATH.
WHY THESE CANNOT BE REMOVED IS ANY BODYS GUESS.
news of arrest ( WHILE DEMANDING HUGE AMOUNTS FOR ILLEGAL CONSTRUCTION )of BJP AND CONGRESS COUNCILLORS is not denting the zeal of greedy persons to make a fast buck by illegal construction.
The point regarding vehicles in utter disregard of traffic lights in presence of TRAFFICE POLICE AND CONTROL ROOM VAN AT MADHUVAN CHOWK WAS MADE BY SEVERAL RESIDENTS.
FINALLY POLICE OFFICERS PRESENT ASSURED REDRESSAL.
I SUBMITTED THAT LOT OF PROBLEMS CAN BE SOLVED IF MEETINGS ARE CONDUCTED AT THANA LEVEL

I am enclosing a copy of the Delhi Prevention of Defacement of Property act, 2007 which became effective wef 1 Mar, 2009. It is only two pages and takes about 2 minutes to read. We meet many people in our daily life and most persons are still ignorant about this Act.

We request you all to kindly forward it to all your friends & relatives as well as kindly post on your social sites so that it reaches each & every citizen of Delhi. 

There was a news item in HT & TOI of 06-12-2011, wherein MCD had announced penalty for illegal defacements. We should make use of this opportunity and help MCD in clearing your areas.

NOTIFICATION

F.14(28)/LA.   The following Act of the Legislative Assembly of the National Capital Territory of Delhi received the assent of the President of India on the 17th, January 2009 and is hereby published for general information :-
“ The Delhi Prevention of Defacement of Property Act, 2007 “
(Delhi Act 1 of 2009)
(As passed by the Legislative Assembly of the National Capital Territory of Delhi on 31st March 2008 )

An Act to provide for the prevention of defacement of properties and for matters connected therewith or incidental thereto in the National Capital Territory of Delhi.
                BE it enacted by the Legislative Assembly of the National Capital Territory of Delhi in the Fifty-ninth year of the Republic of India as follows:-
1.       Short title, extent and commencement
(1)    This Act may be called the Delhi Prevention of Defacement of Property Act, 2007.
(2)    It extends to the whole of the National Capital Territory of Delhi.
(3)    It shall come into force on such date as the Lieutenant Governor of the National Capital Territory of Delhi may, by notification in the Official Gazette, appoint.

2.       Definitions
In this Act, unless the context otherwise requires, -
(a)    “defacement” includes impairing or interfering with the appearance or beauty, damaging, disfiguring, spoiling or injuring in any other way whatsoever and the word “deface” shall be construed accordingly;
(b)   “Lieutenant Governor” means the Lieutenant Governor of the National Capital Territory of Delhi appointed by the President under Article 239 and designated as such under Article 239AA of the Constitution;
(c)    “property” includes any building, hut, structure, wall, tree, fence, post, pole or any other erection;
(d)   “writing” includes printing, painting, decoration, lettering, ornamentation etc., produced by stencil.

3.       Penalty for defacement of property
(1)    Whoever defaces any property in public view by writing or marking with ink, chalk, paint or any other material except for the purpose of indicating the name and address of the owner or occupier of such property, shall be punishable with imprisonment for a term which may extend to one year, or with fine which may extend to fifty thousand rupees, or with both.
(2)    When any offence is committed under sub-section (1) is for the benefit of some other person or a company or other body corporate or an association of persons ( whether incorporated or not) then, such other person and every president, chairman, director, partner, manager, secretary, agent or any other officer or persons connected with the management thereof, as the case maybe, shall, unless he proves the offence was committed without his knowledge or consent, be deemed to be guilty of such offence.
(3)    The aforesaid penalties will be without prejudice to the provisions of Section 425 and Section 434 of the Indian Penal Code , 1860 (45 of 1860) and the provisions of relevant Municipal Acts.

4.       Composition of offences
(1)    Any offence of defacement whether committed before or after the commencement of this Act punishable under Section 3, may either before or after the institution of the prosecution, be compounded by such officers or authorities and for such amount as the Government may, by notification in the Official Gazette, specify in this behalf.
(2)    Where an offence has been compounded under sub section (1), the offender, if in custody, shall be discharged and no further proceedings shall be taken against him in respect of such offence.

5.       Offence to be cognizable
An offence punishable under this act shall be cognizable

6.       Power of the Lieutenant Governor to erase writing, etc.
Without prejudice to the provisions of Section 3, it shall be competent for the Lieutenant Governor to take such steps as may be necessary for erasing any writing, freeing any defacement or removing any mark from any property.
7.       Act to override other Laws
The provisions of this Act shall have effect notwithstanding anything to the contrary contained in any other laws for the time being in force:
Provided that the provisions of this Act shall not be applicable to advertisements displayed at duly authorised public spaces for advertising by appropriate authorities.
8.       Repeal  and Savings
On the day on which the Delhi Prevention of Defacement of Property Act,2007 comes into force , the West Bengal Prevention of Defacement of Property Act, 1976 ( Bengal Act no.21 of 1976)  as extended to the National Capital Territory of Delhi shall cease to have effect except in case of things done or omitted to be done before the commencement of this Act.

In exercise of the powers conferred by sub-section (3) of section 1 of the Delhi Prevention of Defacement of Property Act, 2007 ( Delhi Act 1 of 2009 ), the Lt Governor of the National Capital Territory of Delhi is pleased to appoint the 1st day of March, 2009 as the date on which the said Act shall come into force.

Explanations
1.   Defacement is basically of four types as under :-
        ( a )   Posters
        ( b )    Hoardings
        ( c )   Banners
        ( d )   Writings on the wall.
2.   Property includes any property in public view like buildings, hut, structure, wall,
      poles / posts, trees, roof tops or any other erection.
3.   The guilty of the defacement shall be the owner, President, Director, Partner, agent or   
       any other officer responsible with the management thereof.

8 Councillors suspended after sting operation

I write not because I am shocked to hear something which we all had known for long but saddened ,yes!.Such stings will continue to be the breaking news till the time we citizens show a collective sincere willingness to break this cycle.We all are aware that govt has passed 50% reservation bill for women.In this sting operation five of the councillors are women belonging to two major political parties.Can we expect true representation of women in politics?we dont have much hope for that, as long as the criteria for issuing tickets to women candidates is based on achievements of their men folk in politics or their political loyalties.

 The change we wish to see can be brought about by the citizens who pledge to vote intelligently by looking at the merits ,qualification and competency of  women candidate and not voting for her because she is the wife ,sister or mother of a political bigwig or we shall be seeing too many Rabree devis contrary to what we wished to see with the all empowering womens bill.Should we citizens be complaining ? after all it is the result of choices we make on misguided or misrepresented merits.

MCD budget proposes increased property tax, congestion charges

New Delhi, Dec 7 (PTI) Delhiites may have to shell out more money as tax under several heads with the Municipal Corporation of Delhi today proposing an increase in property tax and introduction of congestion charges at crowded places.

Presenting the budget for 2012-13, MCD Commissioner K S Mehra proposed increase in parking charges, street parking charges and property charges besides introducing new charges like congestion charges and conservancy charges.

The budget proposed the introduction of congestion charges in commercial areas of Karol Bagh, Paharganj and City Zones of MCD to notify road stretches for imposing charges.

MCD plans to cough up an extra Rs 180 crore through street parking charges while it expects the proposed 3-5 per cent increase in property tax to fetch another Rs 150 crore.
......

A sum of Rs 100 crore is what the civic body expects to collect through conservancy charge -- Rs 5,000 to be collected from those who organised social, religious, political and other functions which generate garbage while parking charges is expected to fetch Rs 40 crore and congestion charge Rs 50 crore.
